Port of San Diego Appeals Court Ruling to Allow Measure on Nov. 4 Ballot (Update)

A court ruling allowing voters to decide whether hotels, restaurants or sports complexes can be built at the Tenth Avenue Marine Terminal was appealed this afternoon by the Port of San Diego. (Update: Added related documents below)

The appeal, filed in the Fourth District Court of Appeal in San Diego, asks the appellate court for an immediate stay of any and all steps required to be taken by the San Diego County Registrar of Voters to place the Initiative on the ballot for the November 4, 2008, election.
Superior Court Judge Ronald L. Styn issued a ruling last week allowing the initiative, "The Port of San Diego Marine Freight Preservation and Bayfront Redevelopment Initiative", to be placed on the November ballot. It is that ruling which the Port is appealing.
