Home Business Equal Opportunity Contracting Information

The Procurement Services Business Opportunities Group is responsible for implementing the Equal Opportunity Contracting program. It is the policy of the District that all businesses are provided equal opportunity to participate in the performance of District contracting and leasing opportunities. The District is committed to take all necessary and reasonable steps to increase its utilization of small businesses.

Small Business Enterprise Resource Information Guide

It is the policy of the San Diego Unified Port District (District) that all businesses be provided equal opportunity to participate in the performance of District contracting and leasing opportunities; and to insure that, workers on public works projects of one thousand dollars ($1,000) or more are paid the general prevailing rate of per diem wages for regular, holiday, and overtime work as provided by California Labor Code Section 1771.

The District is committed to take all necessary and reasonable steps to increase its use of small businesses for a positive economic impact to the region. Bidders shall be fully informed regarding the requirements contained in the bid specifications, Section 1D, and the District's SBE Plan. All bidders should make good faith efforts to include SBE participation.

This Resource Information Guide has been compiled to assist you with your good faith efforts. The Links will provide you access to SBE firms that provide the type of services or relative materials or supplies that would be counted toward any SBE goal.

Also included is a Link entitled "Documentation of Good Faith Efforts." This form must be completed and provided to the Equal Opportunity Management Office by twelve noon of the next working day following the bid opening. The completed form should reflect the good faith efforts made prior to bid opening.

Bidders are encouraged to contact Equal Opportunity Management Office, if you have any questions, need assistance with obtaining current information on SBE listings, or need additional information relative to the Equal Opportunity Program requirements.

Labor Compliance Program

Contractors on District public works projects are subject to State and Federal laws and regulations governing the payment and reporting of wages, the use of apprentices, and other applicable labor standards provisions. EOM staff monitors prime contractors' and subcontractors' compliance with labor standards by conducting a review of weekly certified payroll reports; interviewing contractors' workers at the construction site; and, when appropriate, conducts audits of contractors' records and engages in other activities, as necessary, to ensure contractors' compliance. EOM makes pre-construction presentations to inform contractors of their obligations to comply with labor standards provisions.

   

Equal Employment Opportunity (EEO) Program

The primary objective of this program is to ensure that all personnel actions are administered in a manner so as to further the principle of equal employment opportunity. Program efforts specifically address both internal and external applicants for District employment opportunities. To achieve the program objectives, EOM conducts outreach, including participation in job fairs; tracks the flow of applicants throughout the examination process; participates in the new employee orientation process; and may review complaints of discrimination.

Equal Opportunity Contracting Program

The objective of the Equal Opportunity Contracting Program is to ensure that all businesses, including those that are socially and economically disadvantaged, be provided an equal opportunity to compete for District contracting and leasing opportunities. Program implementation actions include establishing recommended Small Business Enterprise (SBE) participation levels for District projects; conducting outreach to businesses and organizations that can provide the service required or distribute the information to those that can; participating in the selection process for service providers; and, conducting technical workshops to assist SBEs desiring to do business with the District. Additionally, EOM monitors payments to SBEs to ensure they receive the percentage of work promised them by primes at the time of contract award.

   

SPARTA Insurance Program

The San Diego Unified Port District offers SPARTA, an insurance program designed to provide Commercial General Liability, Excess General Liability and Professional Liability insurance coverage to vendors who do not have insurance, or have inadequate limits, to successfully bid and compete for business with the District. SPARTA is less expensive than a standard insurance policy because the coverage provided is specifically for the job or contract the vendor has with the District.
